Welcome to SK8PES. These Terms and Conditions (“Terms”) govern your access to and use of shop.sk8pes.com (the “Site”) and any purchase you make from us. SK8PES is operated by NFCB Enterprises LLC (“we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase. By placing an order you confirm that you meet this requirement and that the information you provide is accurate and complete.
2. Products and Availability
All products are described and priced as accurately as possible. Product photos are for illustration; actual colors may vary slightly due to screen settings and the nature of washed and dyed garments. We reserve the right to limit quantities, discontinue any product, or correct errors in pricing or descriptions at any time, even after an order has been submitted. If we cancel an order for these reasons, you will receive a full refund.
3. Made-to-Order Production
Most SK8PES items are produced specifically for your order after you purchase. Please allow approximately 1-6 business days for production, plus 5-15 business days for shipping, for a total estimated delivery window of roughly 1-3 weeks depending on your location. International orders may take longer. You will receive tracking information once your order ships.
4. Pricing and Payment
All prices are listed in U.S. dollars and do not include shipping or any applicable taxes unless stated at checkout. Payment is processed securely through our third-party payment processor (Stripe). We do not store your full card details on our servers. By submitting payment, you represent that you are authorized to use the payment method provided.
5. Sizing and Fit
Our garments are designed with specific fits (for example, oversized or drop-shoulder cuts). Because items are made to order, please review the size chart on each product page before purchasing. If you are unsure, contact us at sk8pesbrand@gmail.com before you buy and we will help you choose.
6. Returns, Refunds, and Exchanges
Please see our Refund and Returns Policy, which is incorporated into these Terms. In summary: because every item is made to order, all sales are final. We do not offer refunds or exchanges for incorrect size selection, change of mind, or buyer’s remorse. If your item arrives damaged, defective, misprinted, or is not what you ordered, contact us at sk8pesbrand@gmail.com within 7 days of delivery with photos and we will make it right.
7. Shipping and Risk of Loss
Delivery timeframes are estimates, not guarantees, and may be affected by carrier delays, customs, or events outside our control. Title and risk of loss pass to you once the carrier receives the package. You are responsible for providing an accurate shipping address; we are not liable for orders lost due to an incorrect address you provided.
8. Intellectual Property
All content on the Site – including the SK8PES name, logo, artwork, graphics, product designs, and text – is owned by NFCB Enterprises LLC or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, resell, or use any of it without our prior written permission.
9. Acceptable Use
You agree not to use the Site for any unlawful purpose, to interfere with its operation, to attempt to gain unauthorized access to any part of it, or to place fraudulent orders. We may suspend or cancel access or orders that violate these Terms.
10. Disclaimers and Limitation of Liability
The Site and products are provided “as is” to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free. To the maximum extent permitted by law, NFCB Enterprises LLC’s total liability arising from any order or use of the Site is limited to the amount you paid for the product at issue.
11. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California.
12. Changes to These Terms
We may update these Terms at any time. The “Last updated” date at the top reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
